Hello. I was recently charged with possession with intent charges from a very aggressive prosecutor. While fighting this good fight, I have lost my father, whom I was the primary caregiver to. Now they want to take my dads home, along with other assets. My father died in the home and we have pets buried in the backyard. Civil forfeiture is a very real and completely devastating reality in the United States. The authorities, whether federal, local, or state, have the “rights” to take your personal property, before you are proven guilty. Does this sound like America? Absolutely not!
Civil forfeiture laws give the police the right to seize and sell private property of anyone accused of committing a crime. Though the burden of proof is on the Prosecutor, it is significantly less stringent than what is required in a criminal court thereby allowing property and funds to be seized without a criminal conviction. And even more terrifying, the same individuals who conduct the seizures are the ones who benefit from said seizures, with the law allowing them to retain a large portion of the seized property’s value.
This is exactly what is happening to a close friend and their family. Virginia has an active and quite open grey market since cannabis was legalized in 2022. The state legalized recreational use, but failed to create the legal framework for sales and gifting. Because of this, numerous markets have popped up to assist people in enjoying their rights. Despite this, some are being prosecuted including my dear friend.
My friend, along with others, set up an event for like-minded people to enjoy good company, good herb, and good times. The event was private and on private property yet the police raided the event and took my friend and a few others to jail immediately. Luckily, they have all since been released on bond, however my friend’s nightmare was just beginning.
My friend was the full-time caregiver for her father, who passed because she was imprisoned. A heartbreak to be sure, however the pain does not end there.
The authorities have since overcharged her with nine felonies, emptied her bank account, searched her home and removed all cash and sent notices of civil forfeiture of all of these things as well as her father’s home (it was his home where they were arrested). She is facing imprisonment, but she is most devastated by the loss of her father and desperately wishes to hang on to the home he passed in and where their beloved family pets are buried. The only chance of helping is to “buy” back the home but there are no funds since they have all been confiscated.
The authorities should allow for a “trade” if she can come up with the value of the home. So regrettably we must turn to our friends in the 420 community and beg for your support. Please dig deep and donate all you can to help fight the cruel consequences of the war on cannabis. Saving this family’s home would be a small bit of justice in an otherwise incredibly unjust situation.
